
Agency Funded Noise Studies with Private Acoustical Consultants: An Overview of the New York City Fair Attenuation Program
The New York City E-designation program, managed by the Mayor's Office of Environmental Remediation (NYC OER), ensures compliance with environmental requirements (i.e., hazardous materials, air quality, and window/wall attenuation) before new buildings are permitted and occupied on
land that has been rezoned or otherwise evaluated in an environmental assessment/impact statement per the New York City Environmental Quality Review (CEQR). NYC OER has become increasingly aware of excessive noise reductions mandated by the (E) designation program due to many factors, including
noise measurements that were not performed adjacent to the proposed development. These requirements may be greater than those necessary to protect public health, which may create a financial burden for affordable housing developers. In order to address this problem for affordable housing projects
fully funded by New York City, NYC OER has created the Fair Acoustical Attenuation Program. To date, these noise measurements performed by AKRF, Inc and funded by NYC OER are aimed at either setting or modifying existing window/wall attenuation requirements based on site-specific noise measurements.
As of today, OER has spent less than $60,000 in study costs and saved affordable housing developers approximately $1,500,000 in development costs due to the reduced window/wall attenuation requirements.
